Terms and Conditions of Sale — Products

These Terms apply when you purchase physical products from BenchBod Electronics through benchbod.com.
1. About Us
BenchBod Electronics (“BenchBod”, “we”, “us” or “our”) supplies electronics-related products, merchandise and other goods.
2. Products
We make reasonable efforts to display products, descriptions, specifications and photographs accurately.
Minor differences in colour, packaging or appearance may occur.
Where products are handmade, modified, refurbished or produced in small quantities, reasonable cosmetic variations may occur and will not by themselves constitute a defect.
Any significant known condition affecting a refurbished or used product will be described before purchase.
3. Orders
Submitting an order constitutes an offer to purchase the goods.
An order is accepted when we confirm acceptance or dispatch the goods, depending upon the checkout process used.
We reserve the right to decline or cancel an order before acceptance, including where:
an item is unavailable;
there is an obvious pricing or description error;
payment cannot be authorised;
we cannot reasonably deliver to the supplied address; or
we reasonably suspect fraud or misuse.
If payment has already been taken for an order that we cannot accept, it will be refunded.
4. Prices and Payment
Prices displayed on the Website are in pounds sterling (£) unless otherwise stated.
Any applicable delivery charges will be shown before the customer completes the purchase.
You must pay using one of the payment methods offered at checkout.
5. Delivery
Available delivery methods and charges will normally be displayed during checkout.
Unless another delivery period has been agreed, we will dispatch and deliver goods within the period required by applicable consumer law.
Please provide a complete and accurate delivery address.
6. Risk and Ownership
Risk in goods passes to you in accordance with applicable consumer law, normally when the goods are delivered into your physical possession or that of a person identified by you to receive them.
Ownership passes once full payment has been received.
7. Your Right to Cancel
If you are purchasing as a consumer online, you will normally have a legal right to cancel your order without giving a reason.
For most goods, the cancellation period expires 14 days after the day on which you, or someone nominated by you other than the carrier, receives the goods.
Different rules may apply to orders consisting of multiple deliveries.
Some goods are legally exempt from the cancellation right, including certain personalised or made-to-order products and other categories specified by law.
To cancel, you must clearly tell us that you wish to cancel the contract.
8. Returning Cancelled Orders
Following a valid cancellation, goods should normally be returned within 14 days.
Unless the goods are faulty, incorrectly supplied or we have agreed otherwise, you will normally be responsible for the direct cost of returning them.
You must take reasonable care of goods while they are in your possession.
We may make a deduction from a refund where permitted by law if handling beyond what would reasonably be allowed in a shop has reduced the value of the goods.
9. Refunds
Where you validly exercise your statutory cancellation right, refunds will be made in accordance with applicable consumer law.
This normally includes the purchase price and the cost of our least expensive standard delivery method offered for the order.
We may withhold the refund until we receive the returned goods or you provide evidence that they have been sent back, where permitted by law.
10. Faulty Goods
Nothing in these Terms limits your statutory rights.
Goods must meet the standards required by the Consumer Rights Act 2015, including requirements relating to satisfactory quality, fitness for purpose and correspondence with their description where applicable.
If a product is faulty, please contact us with your order details and a description of the problem.
11. Liability
Nothing in these Terms excludes or restricts liability where doing so would be unlawful.
We are not responsible for losses that were not reasonably foreseeable when the contract was entered into.
Products sold for a particular technical application must be used appropriately and in accordance with any supplied instructions, ratings and safety requirements.
12. Personal Information
Personal information supplied in connection with an order will be processed in accordance with our Privacy Policy.
13. Governing Law
These Terms are governed by the laws applicable in England and Wales.
Nothing in this section removes any mandatory jurisdictional rights available to consumers.
